Recognition and enforcement of foreign court decisions in Ukraine. What if only one of the debtors lives or has assets in Ukraine? Opinion of the Supreme Court of Ukraine

As of point 2 of the Ukrainian Supreme Court’s Decision No. 12 on 12/24/1999 “About practice of consideration by courts of petitions for recognition and enforcement of foreign courts decisions and arbitrations as well as about cancellation of the decisions made by way of the international commercial arbitration on the territory of Ukraine”, In the event that the decision of a foreign court (arbitration) is made in respect of several debtors, some of whom do not live (are not) in Ukraine and have no property in its territory, the court considers the recognition and enforcement of foreign decision only in respect of debtors who live ( are) on the territory of Ukraine or have property there.
